Terms of service

1. Acceptance of terms
These terms of service are an agreement between you and Moodlog, LLC ("moodlog", "we", "us"). By creating an account, checking the agreement box, or using moodlog ("the service"), you agree to be bound by these terms. If you do not agree, do not use the service.
When we make material changes to these terms, we ask you to review and agree again inside the service before continuing (see section 15).
2. Description of service
moodlog is a personal journaling tool for surfacing emotional insights. The service lets you write entries, tag them with emotions, and see descriptive readings and recurring patterns computed from your own writing, including automated suggestions produced by machine learning models running on our servers. These readings are descriptive observations about your writing, not assessments, diagnoses, scores, or screenings, and they may be incomplete or wrong.
The service is for your personal, non-commercial use.
3. Research preview status
moodlog is currently an invite-only research preview. Features may change, be added, or removed at any time. We make no guarantees about service availability, data persistence, or feature stability during this period, and we may suspend or discontinue the service in whole or in part. If we discontinue the service, we will make reasonable efforts to give you notice and an opportunity to export your data first.

Important: moodlog is not a medical tool and not a crisis service.
moodlog is not a medical device, diagnostic tool, or substitute for professional mental health care. The service, including its automated readings and suggestions, does not provide medical advice, diagnosis, or treatment, and no clinician-patient relationship is created by using it. Always seek the advice of qualified health providers with questions about your mental or physical health, and never disregard or delay professional advice because of something you read in the service.
moodlog is not monitored for crisis content and cannot respond to emergencies. If you are in crisis or thinking about harming yourself or others, call or text 988 (Suicide and Crisis Lifeline, US), call your local emergency number, or go to the nearest emergency room. 7. Your content
You own your journal entries and everything you write in the service. So that we can operate the service, you grant moodlog a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, analyze, and display your content, solely to provide and improve the service for you. This includes running our machine learning analysis (emotion suggestions, pattern detection, language analysis) on our own servers. This license ends when you delete your content or your account, except for copies in routine backups and copies we must keep for legal reasons, which are deleted on our normal schedules.
Use of your content in research is separate, opt-in only, and governed by the privacy policy. If you send us feedback or suggestions about the service, we may use them without obligation to you.
8. Fees
The service is free during the research preview, and we do not collect payment information. If we introduce paid features in the future, we will give you advance notice and clear pricing, and paid features will require your separate agreement before you are charged.
9. Intellectual property
The service, including its software, design, and branding, is owned by Moodlog, LLC and protected by intellectual property laws. These terms do not grant you any rights in the service other than the right to use it under these terms.
10. Data and privacy
Our privacy policy describes what we collect, how entries are encrypted, who can access what, and your choices, including the research data sharing setting, which is off by default. Please read it; it is where our data practices are stated.
11. Termination
You may delete your account at any time in your account settings; deletion runs on a 30-day grace period you can cancel within, as described in the privacy policy. We may suspend or terminate your access if you violate these terms, if we are required to by law, or if we discontinue the service under section 3. On termination, your right to use the service ends. Sections 6, 7 (as to feedback), 9, 12, 13, 14, and 16 survive termination.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DATA WILL NOT BE LOST, OR THAT AUTOMATED READINGS AND SUGGESTIONS WILL BE ACCURATE. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOODLOG, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE SAME EXTENT, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AND ONE HUNDRED US DOLLARS (USD 100).
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot be limited by law.
14. Indemnification
You agree to indemnify and hold harmless Moodlog, LLC from claims, damages, and reasonable costs (including attorneys' fees) arising from your violation of these terms or your unlawful use of the service.
15. Changes to terms
We may modify these terms. If a change is material, we will present the updated terms inside the service and ask for your agreement before you continue using it; the effective date above will change. For non-material changes, continued use of the service after the updated terms are posted constitutes acceptance.
16. General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets. These terms and the privacy policy are the entire agreement between you and moodlog about the service.
